Why Trademark Registration Matters for Your Business

Registering a trademark is a crucial step in protecting your brand and securing your business identity in the market. In Indonesia, trademark registration is handled by the Directorate General of Intellectual Property (DGIP). A registered trademark not only grants exclusive rights to the owner but also ensures legal protection, reduces the risk of disputes, and strengthens your brand’s credibility in the eyes of consumers and business partners.

Our trademark registration service starts from IDR 3,000,000, covering consultation, document preparation, and submission to DGIP.

Legal Basis for Trademark Registration at DGIP

Law Number 20 of 2016 on Trademarks and Geographical Indications (Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis)

  1. Article 1 point 1
A trademark is a sign that can be represented graphically in the form of images, logos, names, words, letters, numbers, color compositions, in two-dimensional and/or three-dimensional forms, sounds, holograms, or a combination of two or more of these elements, used to distinguish goods and/or services.
  2. Article 3
Trademark rights are obtained after the trademark is registered.
  3. Article 3 paragraph (1)
The registered trademark owner has the right to file a lawsuit against any party using an identical or substantially similar trademark without permission.

Why Should You Register a Trademark with DGIP?

  1. Obtain Exclusive Rights
Only the registered trademark owner has the legal right to use the mark in commercial activities.
  2. Legal Protection
Without registration, a business owner cannot take legal action against parties who use the trademark illegally (as the law only protects registered trademarks).
  3. Avoid Trademark Disputes
Failing to register a trademark may lead to legal disputes with other parties who registered a similar mark first.
  4. Company Asset
A registered trademark has commercial value and can be licensed, franchised, or even sold.
  5. Increase Consumer Trust
A registered trademark boosts a company’s credibility in the eyes of consumers, business partners, and investors.

OSS Transition to OSS RBA – Who is it for and what are the benefits

Online Single Submission Risk Based Approach (OSS-RBA) or Risk Based Business Licensing is a business licence granted to business actors to start and run their business activities which are assessed based on the level of risk.

OSS RBA licences are only required by businesses with high-risk business activities. Meanwhile, businesses with low to no risk will generally not require licenses or inspections from the government.

With this risk-based system, it will be easier for high-risk businesses to apply for business licenses so that business licenses that require verification will be minimized.
